7 Pitfalls To Avoid in Your Separation or Divorce in Ontario!

The biggest problem with getting separated or divorced is knowing where to start and avoiding some serious pitfalls that can derail your family law case.

Hi, my name is Thomas O’Malley.  I’m an experienced family lawyer in Durham Region and the GTA.

Here’s some really important pitfalls to avoid when you start down the separation or divorce road:

 1.  Listening to the wrong people!

You will definitely have your friends, family members, and co-workers tell you what happened in their separation or divorce and what you should do to win in your family law case.

This is the problem:  Although these people mean well, they are not experienced family lawyers.    Their advice is based on the specific facts of their case.  Each fact situation is unique.  

What worked for your cousin in their separation or divorce will not necessarily work for you.

You need to get the advice of an experienced family lawyer to guide you and protect your family law rights in your separation or divorce.

2.  Hiring the wrong family lawyer

You need to give some careful thought to which family lawyer that you hire to help you solve your family law issues.

First, you want to make sure you hire an experienced family lawyer.  That can make all the difference in the world to your separation or divorce.

You also want to ensure you have a good working rapport with your lawyer.  In other words, you want to get along with your lawyer so that you work smoothly together and  you do not bicker or argue with each other.

3.   You are not focused on a fair and reasonable settlement

You should try to avoid family court if you can.  Your family lawyer can advise you on the right approach to take after they have discussed the details of your case with you.

Your best approach is to try to negotiate a fair and reasonable separation agreement with your former spouse.  This will reduce the tension and anxiety and the costs of your separation or divorce.

You should only go to family court when your former spouse continues to take an unreasonable position on important issues in your case.

Your family lawyer can advise you when you should go to family court based and your chances of success on these important issues.
