Are You Making These Technology Mistakes in Your Separation or Divorce in Ontario?

I’ll bet you anything you don’t really realize how technology can cause you some serious problems in your separation or divorce in Ontario!

Hi, my name is Thomas O’Malley.  I’m an experienced family lawyer in Durham Region and the GTA.

Here’s some serious mistakes you can make using technology in your separation or divorce:

 1.  You have not changed your passwords during your separation or divorce!           

I am always surprised at the number of people who forget to change their passwords when they get separated or divorced. 

You need to make sure you change the password for your personal email since you don’t want your spouse reading what your family lawyer has emailed you. 

Change your passwords for your social media accounts so that your spouse cannot get into these accounts.

2.    Don’t Say Anything Negative About Your Spouse!

You must so, so careful about what you say in your text messages and on social media posts.  It’s so easy to write a quick text message because you are angry or frustrated about what your spouse has said or done.

However, you must make sure you read your message carefully before you ever send it to anyone.

You must view your message as though a family court judge was reading it.  If you think a judge would have not have a negative reaction to your message, your message is probably fine.

Negative messages and posts about your former spouse can easily be used against you in family court.

3.   You Forget About What You Are Posting on Facebook!

You need to be so careful about what you post on Facebook. 

Your spouse or their lawyer can easily use these posts against you.

How do you explain that you can’t work at a certain job when you put recent photos of you actively involved in sports and other physical activities, such as mowing the lawn?

You are trying to show your ex-spouse’s lawyer or a family court judge that you can’t pay much spousal support when you have recent photos of expensive vacations and luxurious cars on your Facebook page!

You should not post anything on your Facebook page or any other social media site during your separation or divorce process
