Are You Willing to Face These Serious Problems When Your Spouse Wants a Separation or Divorce in Ontario?

Hi, my name is Thomas O’Malley.  I’m an experienced family lawyer in Durham Region and the GTA.

You definitely need to hire your own experienced family lawyer when your spouse tells you they want to get separated or divorced.

No one can make you hire a lawyer.  There’s no doubt about that.  However, your separation or divorce is usually much more complicated and frustrating than you first realize.

You first need to know in no uncertain terms that you cannot use the same family lawyer as your spouse wants to use even if you and your spouse seems to be on friendly terms. 

This is called a conflict of interest. 

A family lawyer cannot represent both you and your spouse.  They cannot provide legal advice to both of you.  The reason is simple:   Your legal interests and the legal interests of your spouse can be quite different and usually they are.

You can’t afford to face your ex-spouse’s family lawyer without having your own experienced family lawyer on your side.  You really need your own lawyer in particular when your ex-spouse or their lawyer is particularly aggressive and intimidating.

Your lawyer can make sure that your family law rights are protected and that you do not face serious problems in dealing with your former spouse and their lawyer.

Your family lawyer can quickly guide you on how to protect your family law rights and work on getting a fair and reasonable separation agreement.

Your lawyer can make sure that your goals are reasonable based on Ontario family law principles and the facts of your particular case.

You need to make sure your lawyer does not unnecessarily get aggressive with your former spouse when your former spouse and their spouse is acting reasonably in trying to reach a fair settlement with your spouse.

Your lawyer needs to act reasonably in negotiating a fair and reasonable settlement for you.  

However, you also need a lawyer who is prepared to go to family court when your ex-spouse or their lawyer are acting in a difficult manner, especially by pursuing unreasonable goals based on the facts of your case.

When you have an experienced family lawyer working for you, your lawyer will advise you on the best approach to take in your separation or divorce as you move through the separation and divorce process.
