How To Know Whether A Proposed Separation Agreement or Divorce Settlement is Fair!

I don’t have to convince you that you need to know whether your ex-spouse’s proposed divorce or separation agreement or settlement is fair and reasonable.

I will discuss this really important issue in this video.

Hi, my name is Thomas O’Malley.  I’m an experienced family lawyer in Durham Region and the GTA.

Your separation agreement, divorce settlement or family court settlement deals with the important legal issues in your separation or divorce.

These issues usually include child custody and access, now called decision making responsibility and parenting time, child support, spousal support, and property issues.

These issues need to be covered in the proposed separation agreement or family court settlement.

When you are dealing with decision making responsibility and parenting time, you have to closely examine the role of both parents during the relationship or marriage. 

Ontario family law bases the issue of parenting time on the what’s in the best interests of your children.

In many cases now, parenting time is often split so that each parent has the children for half of the time.  For example, many parents have their children on a week-about basis  which means that one parent has the children living with them for a week and then the other parent has the children living with them for a week which continues on a weekly rotating basis.

You need to have specific days and times for the exchange of your children.  This makes life so much easier for you and your children.

You need to make sure you have the summer vacation period covered.  For example, many parents each have their children for two weeks in July and two weeks in August.

You need to cover the holiday, such as Thanksgiving and the Christmas holiday period.

Don’t leave anything to chance for your parenting time.

You also want to make sure that you have the issue of important decision-making about various matters in your children’s lives.  This includes where your children go to school and decisions about medical and dental care.

In fact, you should seriously consider creating a detailed parenting plan as part of the separation agreement or proposed family court settlement.

An effective parenting plan can really bring help you and your children during and after your separation or divorce is finalized.
