The Best Way To Decide Who Gets Your Home in Your Separation or Divorce in Ontario!

The Best Way To Decide Who Gets Your Home in Your Separation or Divorce in Ontario!

There is no better time to start thinking about who gets the house in your separation or divorce than right now.

You don’t have to decide today.  However, you should start giving some serious thought to this important issue.

Hi, my name is Thomas O’Malley.  I’m an experienced family lawyer in Durham Region and the GTA.

Please remember to like this video and subscribe to my Youtube channel if you have not done so already.

Spouses want to keep their home for many different reasons.

A parent wants to keep the house for their children.  They want their children to stay in the same neighborhood and continue to go to the same school.  This helps to give stability to their children while they are coming to grips with their parents’ separation.

Some spouses want to keep their current home since they probably could not qualify for a new mortgage to buy a different home.

Other spouses believe that their home will continue to increase in value so that they want to keep their home after the separation or divorce is finalized.

You have to ask yourself some important questions to decide what you should do with your home as a result of your separation or divorce.

When you ask the right questions, you will find the best way to deal with your home during this really difficult time in your life.

You will see that you have a few options in dealing with your home in your separation or divorce:

1.  You keep your home.

2.  Your spouse keeps the home.

3.  You sell the home and divide the proceeds based on the financial settlement in your case.

4.  You both keep the home for a certain period of time and then sell it; or

5.  You both keep the home for a certain period of time and then one spouse buys out the other spouse’s interest in the home.

Please keep these options in minds as we review the key questions to ask about what to do with your home in your separation or divorce in the next video.
