What Do You Do When Your Ex-Spouse Has Served You With Divorce or Family Court Papers in Ontario?

What do you do when your spouse has you served with divorce or family court papers?

All kinds of ideas must be going through your head at that time as you are experiencing a moment of disbelief!

I will tell you exactly what you must do in this video.

Hi, my name is Thomas O’Malley.  I’m an experienced family lawyer in Durham Region and the GTA.

First, don’t panic.  You need to take a step back and realize that you have 30 days to respond to your spouse’s family court paperwork.

Next, you really need to get the advice of an experienced Ontario family lawyer so that they can advise you about your family law rights and how to protect them.

You should set up an initial consultation with a family lawyer as soon as possible after you have been served with family court paperwork.

You might have been already acting proactively and met with a family lawyer to discover how to protect your family law rights since you knew your marriage or common-law relationship was not going too well.

Your responding court paperwork is critical to your family court success.  You will have to prepare what is called an Answer or a Response to a Motion to Change.

You definitely need to hire an experienced Ontario family lawyer to draft or prepare your court paperwork.  Your lawyer will know exactly what you need to put in your court paperwork so that you have the best chance of success in your case.

In fact, you now have the opportunity to make your own claims in your responding court paperwork. 

You can ask for orders dealing with the main issues in most family court cases: child custody and access, now called decision-making responsibility and parenting time, child support, spousal support, and the property issues.

Take some time to carefully review the responding court paperwork that your family lawyer has drafted for you.

Make sure your family lawyer carefully explains the paperwork to you.

You will have to complete what is called a Form 35.1, an Affidavit about decision-making responsibility, parenting time and contact, when you have dependent children with your spouse.

You also have to complete a detailed Financial Statement in most cases.

This can easily be overwhelming for you.  That’s completely understandable. 

When you hire a family lawyer to represent you in your family court case and draft your responding court paperwork, you dramatically increase your chances of success in your separation or divorce.
