When Should You Do When Your Spouse Has Hired A Family Lawyer?

Let’s be honest: the last thing you want to face in your separation or divorce is your former spouse’s experienced family lawyer.

You might have thought you could deal with the issues in your separation or divorce on your own to save some money.

Is that really a good idea?

Hi, my name is Thomas O’Malley.  I’m an experienced family lawyer in Durham Region and the GTA.

No, it’s not a good idea.  As a minimum, you need to get the advice of an experienced family lawyer in your area so that you truly know and understand your family law rights. 

It’s really important to understand that a family lawyer cannot represent both you and your former spouse. 

Don’t think that your former spouse’s lawyer is making sure your legal interests are protected and respected when they are dealing with you, no matter how nice and reasonable your former spouse’s lawyer seems to be!

When you have been married or living in a common-law relationship for a number of years, you normally require the services of an experienced family lawyer to help deal with your financial issues in your separation or divorce. 

For example, you certainly hire a family lawyer when you or your former spouse have significant assets, such as a home or cottage, and investments.

If you have serious child custody and access issues, you definitely need to get the advice of an experienced family lawyer.

Here’s the bottom line:  Your best chance of success in your separation or divorce is to hire an experienced family lawyer to represent you throughout your separation or divorce.

If you are not going to do that, here are two main situations in which you should definitely hire an experienced family lawyer.   

When you are staying out of family court, you should get the advice of an experienced family lawyer about negotiating a separation agreement that settles your family law issues.

Second, when you are already in family court, you should hire a family lawyer to represent you at the settlement conference stage of your court case.  Your family lawyer can really help at this point in time to settle your outstanding family law issues on a final basis.

To blindly try to represent yourself in your separation or divorce with no family law advice from an experienced family lawyer will often cause you some serious family law problems!
