Why Social Media Can Mean Disaster For You in Your Separation or Divorce in Ontario!
It’s so so important to understand that social media is not your friend in your separation or divorce!
When you are getting separated or divorced, moments of anger and extreme frustration and anxiety are inevitable for most spouses.
This is the time that you are most likely to strike out against your former spouse on social media, such as Facebook or Instagram.
Hi, my name is Thomas O’Malley. I’m an experienced family lawyer in Durham Region and the GTA.
Here’s how social media can mean disaster for you in your separation or divorce:
1. Your Ex-Spouse or Their Lawyer Can Use Your Social Media Posts Against You in Family Court
When you post anything on social media, your former spouse and their lawyer can easily use this post against you in family court.
For example, you keep stating that you are access-friendly parent and that you respect your former spouse as a parent.
However, these statements will blow up in your face if you make posts on social media in which you make seriously negative comments about your former spouse as a parent and you state that you are always late dropping off the kids to your former spouse on purpose to make life more difficult for them.
Nothing on social media is considered private or privileged from a family law point of view.
2. Your Friends on Social Media Platforms Cannot Be Trusted!
You cannot assume that only your Facebook friends, for example, will see your social media posts.
Again nothing is private on Facebook or any other social media platform.
Just imagine how angry you could make your former spouse when she sees a photo of you and your new friend on a social media site at exactly the time you are close to reaching a final settlement in your separation or divorce.
And it was a “friend” who mentioned your photo to another person who happens to be your former spouse’s acquaintance who made sure your former spouse saw the photo!
Here’s the bottom line: anything you post on social can easily derail your separation or divorce case!
