Generally, it is difficult to overturn or set aside a separation agreement or a provision in a separation agreement.
The courts have found that there are two important principles about the validity of a separation agreement. The first principle is that it is desirable for spouses to settle their own family law issues and matters. Spouses will only enter into a separation agreement or a settlement if they can reasonably expect the terms or provisions of the separation agreement to be upheld. Therefore, as a general rule, the courts should enforce separation agreements agreed to by the spouses.
The next principle is that the court will very rarely overturn a separation agreement simply on the ground that a spouse received “a bad deal” in a separation agreement or settlement. The court would have to find that the separation agreement or settlement is unconscionable in order to set aside the separation agreement.
What makes a separation agreement or settlement unconscionable? A court could find a separation agreement or settlement unconscionable when the separation agreement is extremely harsh and unfair and a spouse has taken advantage of the vulnerability of the other spouse. The court will only find a separation agreement or settlement to be unconscionable in very few cases.
The most likely area in which the court will set aside a separation agreement are the provisions that limit spousal support or no spousal support is paid under the terms of the separation agreement. The issue of setting aside the spousal support provisions in a separation agreement is discussed below.

The court can set aside a separation agreement or any provision in it if a spouse did not understand the nature or consequences of the separation agreement. The importance of both spouses having independent legal advice to explain the terms of a separation agreement to them cannot be overestimated.
When a spouse has independent legal advice, it is much more difficult to argue that he or she does not understand the nature or consequences of the separation agreement.
However, you cannot make your spouse see a lawyer. The court has found that a separation agreement will not necessarily be set aside simply because the spouse did not obtain independent legal advice. For example, in one case, the court found that the husband was negligent in not understanding the nature of the separation agreement since he did not obtain independent legal advice when he had the opportunity to get independent legal advice.
In any event, your best protection to make sure a separation agreement is not set aside on the basis of your spouse not understanding the nature or consequences of the separation agreement is to do everything possible to make sure your spouse obtains independent legal advice on the terms of the separation agreement.
The court can set aside a separation agreement for a number of other reasons. These reasons include duress, undue influence, fraud and material misrepresentation.
