How long does the court process take?

When you’re in court, your case could be done in two or three months or it could take a year and a half. This depends on many factors. These factors include how difficult or reasonable your ex-spouse is, the type of approach that your ex-spouse’s lawyer takes in the case, and the judge’s comments on the strength of your case.

When you come to your consultation with Thomas O’Malley, you’ll get a detailed assessment of the strength of your case and blueprint on how to solve your family law issues. It’s a small investment that delivers tremendous benefits.

What exactly is your role in helping me protect my legal rights and settling my family law issues?

I meet with you at your first consultation to get all the details of your situation. I carefully listen to you so that I really understand your concerns and fears.

After you tell me all the facts of your case, I clearly explain your legal rights to you and the steps you need to take to protect your legal rights.

And, most importantly, I tell you in plain English the best approach to take to settle your family law issues or divorce legal problems.

Certainly you can see the benefits of setting up your consultation with me now.

After you hire me to help you to protect your legal rights, I prepare the necessary paperwork that we will need as the basis of settling your family law issues.

Then I start working on a written proposal or separation agreement that we send to your ex-spouse or their lawyer.

If you are in court now, I also prepare your legal documents and I work on an offer to settle or written proposal to settle your legal issues with your ex-spouse.

What are your rates for legal work?

I’m not trying to dodge the question, but I typically determine all legal fees on a per-case basis. There are just too many variables to do it any other way.

That said, you can expect to pay me what you’d pay for many other professional services (an accountant, a contractor, a surveyor, a mechanic etc.).

How much would it be worth to you to protect your legal rights and settle your family law problems or divorce legal issues?

Do I have to go to court?

Absolutely not. I work hard to keep you out of court. I specifically create a plan on how to settle your family law or divorce issues without going to court by preparing a legal document called a separation agreement.

When I prepare a separation agreement for you, you are making a specific written proposal to your ex-spouse to settle all of the issues in your case. Your separation agreement specifically deals with child custody and access, child support, spousal support and property issues.

But sometimes you do have to go to court if your ex-spouse is unreasonable on an important issue, such as child support, and will not change their mind on this issue.

After you come to your consultation with me, you’ll have a really good idea whether you can settle your case without going to court.
