The Fail Safe Way to “Win” in Your Separation or Divorce in Ontario!

There are a lot of myths about “winning” in your separation or divorce in Ontario.

You need to know about the misconceptions or myths of “winning” in your family law case so that you can make the right decisions in your separation or divorce.

Here’s are two more serious misconceptions about “winning” in your separation and divorce in Ontario:

3.    You think your separation or divorce is really simple and there should be no    problems!

One of the real triggers for an experienced family lawyer is the client’s statement that their separation or divorce is quick and easy.

That’s really a red flag for the opposite situation in fact.

When you start asking your client about the details of their situation, you quickly discover that there are key issues that the client did not even think about or consider.

There are rarely quick and easy separations and divorces as many spouses think.

When an experienced family lawyer carefully advises their client about the important legal issues that must be handled in their separation or divorce, the client realizes that the separation or divorce is much more involved than they first realized.

4.   Your home-made separation agreement or court settlement just needs the lawyer’s signature.

When a client approaches me to review a separation agreement or court settlement that they and their spouse have created, I have another big “ugh”! 

The client simply wants me to review the document and sign off on it.

I actually will not review these home-made agreements.  Why?  These home-made agreements quite frankly are usually terrible.  The client or their spouse usually downloaded some totally inadequate separation agreement document from some online site.

I have to make sure that my client’s family law rights are protected.  A good family lawyer can only do that with a property drafted separation agreement or court settlement based on detailed discussions with their client.

And don’t forget, you must have full financial disclosure from your spouse to make sure your family law rights are protected and get a fair and reasonable separation agreement or settlement for you.

In most situations, spouses have not done full financial disclosure when they have tried to create their own separation agreement.

Of course, you must provide full financial disclosure to your former spouse as well.

Make sure you spend some time discussing these important issues with your family lawyer in your separation or divorce.
