The Truth About Getting The Best Results in Your Separation or Divorce in Ontario!

Here’s your opportunity to avoid some more serious mistakes when you’re getting separated or divorced in Ontario!

These are four more serious mistakes you need to stay away from in your family law case.

8.  You don’t have reasonable expectations!

You need to set reasonable expectations or goals in your separation or divorce.  You need to know what is a fair and reasonable outcome dealing with your issues of child custody and access (now called decision-making responsibility and parenting time), child support, spousal support and the property issues.

When you know what are reasonable expectations or goals based on the facts of your case and the application of Ontario family law principles to your case, you can adopt a strategic approach to case to finalize your issues quickly and successfully.

Your family lawyer can undoubtedly help you figure out what your reasonable expectations and goals should be respecting these legal issues in your case.

9.  Trying to prove your ex-spouse is a liar or just a bad person!

This is really serious mistake.  You need to stay focused on the real legal issues in your separation or divorce.

You don’t try to negotiate a separation agreement or go to family court to prove that your former spouse is a liar.   In most cases, this is just not relevant.  If your spouse is misleading or lying about important issues, such as their income, that’s a different matter.

What I’m talking about is a serious focus on showing that your ex-spouse has lied about issues that are just not relevant from a legal point of view.  This approach will simply cost you thousands of dollars and drag out your separation or divorce. 

Your lawyer can advise you on what legal issues you need to focus on.

Similarly, simply trying to show that your ex-spouse is a bad person is not the right focus in dealing with the legal issues in your case.

10.  You don’t carefully consider what’s best for your children

You certainly place your kids first in your life, especially as you deal with your separation or divorce.

You need to carefully consider what’s the best parenting plan and arrangements for your children. 

Most parents realize that their children will do better in their lives and enjoy more stability as well when both parents are seriously involved in their children’s lives.

Create a parenting plan that best suits your children so that they will have the best lives that they can have even with parents in two separate households now.

Don’t make your children feel guilty about any aspect of your separation or divorce and don’t treat them as pawns in any conflict with your former spouse.

Your children deserve the best that you can give them!

11.  You don’t start working on getting a settlement proposal to your former spouse as soon as possible.

You need to work on getting a settlement proposal to your ex-spouse as soon as you can. 

Of course, you need to get full financial disclosure from your former spouse before you actually send a separation agreement or settlement proposal to your spouse.

The fastest way to actually settle your family law issues in your separation or divorce is to negotiate a separation agreement and keep out of family court.
