How To Win in Your Separation or Divorce by Doing The Unexpected!

It’s a fact of life that I help clients survive one of the most difficult times in their life-their separation or divorce.

My job as a family lawyer to make sure that I protect my clients’ family law rights and show them how to get the best outcome for their case based on the facts of their situation and the applying Ontario family law principles to their situation.

What really makes it more difficult for my clients and any spouse getting separated or divorced is that these spouses are bombarded with serious misunderstandings and misconceptions about the separation and divorce process in Ontario.

I will discuss these serious misunderstandings and misconceptions about the separation and divorce process in this video.

In fact, a major part of my job is to make sure that my clients understand the separation and divorce process in Ontario so that they have reasonable expectations about the process.

A spouse getting separated or divorced will actually “win” in their separation or divorced by taking the often-unexpected action of acting in a reasonable manner and pursuing reasonable goals and objectives in their separation or divorce based on their experienced family lawyer’s advice.

Here’s four major misconceptions that spouses getting separated or divorced must understand to actually “win” in their separation or divorce:

The first major misunderstanding is based on this common statement from my clients: “I want to get what I want and nothing else will do.”

Many spouses getting separated or divorced are understandably angry and upset, even when they are the spouse who wants to get separated or divorce.

However, I tell my clients that you cannot let that taint your view of the separation and divorce process.

You want to “win” in your separation or divorce no matter what the cost is.

However, this is not a realistic approach whatsoever in your separation or divorce.  This is simply a matter of making sure you get a certain amount of money, such as in a personal injury law case.

Ultimately, you face a range of options and choices in your separation or divorce.  The key is to make sure you get an outcome or result based on a reasonable option or choice in our particular case.

For example, if you and your spouse have been fairly equally involved in raising your children, it is highly unlikely that you will “win” in your separation or divorce by trying to make sure that your spouse does not have parenting time or access to the children much. 

First, your spouse is unlikely to accept that position in any type of separation agreement or court settlement. 

Then, you also have to realize that a family court judge is highly unlikely to make a court order in which your children have little time with his kids based on your fact situation.

Here’s another example:  you think you do not have to pay any or very little spousal support to your former spouse when there is a really big difference in your income and you have been married or living in a common-law relationship for a few years.

Undoubtedly, you want to carefully review your particular situation with your family lawyer about the issue of spousal support.  However, in many cases, a spouse has to realize that they will pay more spousal support than they really want to pay to their former spouse.

In short, you will face heavy legal costs, frustration and anxiety and ultimately lose your case if you continue to take an unreasonable position in your family law case.

You need to base your goals and objectives in your case based on the advice of an experienced family lawyer.  Then you will be in the best position to “win” in your separation or divorce.
