The Ultimate Checklist For Getting a Fair and Reasonable Separation Agreement or Divorce Settlement!

If you really want to know whether your former spouse’s proposed separation agreement or divorce settlement is fair, make sure you use this divorce or family law settlement checklist.

I discuss this really important checklist in this video.

Hi, my name is Thomas O’Malley.  I’m an experienced family lawyer in Durham Region and the GTA.

Make sure the proposed agreement covers these important areas and answers these questions:

Child Custody and Access (now called Decision-Making Responsibility and Parenting Time)

• Do you get as much parenting time as you want?
• Do you want your children for half of the time?  Does this make sense in your particular situation?
• Are holidays and summer vacation shared fairly with the other parent?
• Are specific days and times set out for pick up and drop off for your children?
• Will you and your former spouse make decision jointly about your children’s school, sports activities, and medical decisions?

Child Support and Section 7 Expenses

• Have you received a recent paystub from your spouse that shows their year-to-date income?
• Do you or your former spouse have to pay the full amount of child support or a set-off amount of child support since you and your spouse both have the children for roughly half of the time?
• Do you and your former spouse have to agree in writing before any costs are incurred for your children’s sport activities, other programs, and costs that child support does not cover?

Spousal Support

• Have you reviewed the SSAG calculations for how much spousal support you should pay or receive in your particular case?
• Have you carefully examined the issue of the length of time that spousal support should be in your separation or divorce?
• Have you considered putting a review clause for spousal support in your separation agreement or court settlement?

Property Division

• Have you exchanged Financial Statements with your former spouse?
• Have you made sure that you have listed all of your debts and allowable deductions on your Financial Statement?
• Have you made the property payment calculation with a Net Family Property Statement?

General

• Do you clearly understand each paragraph and section of your spouse’s proposed separation agreement or divorce settlement?
• Have you made sure you have received the advice of an experienced Ontario family lawyer so that you can really make sure that any proposed separation agreement or divorce settlement is fair and reasonable for you?

When you consider these important questions in this checklist, you will be much closer to knowing whether your former spouse’s proposed agreement is really fair for you or simply a bad deal that you must not accept.
