A Really Big Separation, Divorce and Family Law Mistake!

Here’s what it’s about: You try to settle your separation, divorce or family court issues without the help of an experienced Ontario family lawyer.

Increasingly, I hear about people who can afford to hire an experienced family lawyer trying to negotiate their own separation agreement or family court settlements.
Why is this such a big problem?
First, stop and think about this: would you try to wire your own house and then complain when your house burns down and you weren’t an electrician in the first place?
Here’s the really big problem you face with a written settlement or separation agreement: they are considered a final resolution of your outstanding family law issues.
When you settle your family law issues, especially with respect to your home and financial assets, this is a permanent situation. You can’t change this later.
Most settlement documents and separation agreements contain release clauses in which you cannot revisit the property and other financial aspects of your written agreement at a later date.
For example, a spouse could agree to transfer their interest in the home for a certain amount of money pursuant to the terms of a written settlement or separation agreement. Later, the spouse finds out they should have received much more for their interest in the house. The spouse usually will have no remedy available to fix this problem since the separation agreement contains a clause in which both spouses agree that the agreement contains a final resolution of all issues in their separation or family law case.
In another example, a spouse fails to make an important deduction in calculating their net worth, such as deducting the value of their investments on the date of marriage, so that they end up paying a lot more money to their spouse than was required if they had made this important deduction.
I could go on and on with the errors that a spouse can make without the help of an experienced family lawyer at their side.
