Get Rid of These Expectations in Your Separation or Divorce in Ontario Before It’s Too Late!
I’m about to reveal to you several expectations you probably have about your separation or divorce that can really hurt your chances of success!
Hi, my name is Thomas O’Malley. I’m an experienced family lawyer in Durham Region and the GTA.
You need to get rid of these expectations so that you get the best outcome in your separation or divorce:
1. You don’t need a family lawyer!
You always need the advice of an experienced family lawyer to protect your family law rights in Ontario.
When you get the advice of an experienced family lawyer, you can make sure you can get a fair and reasonable separation agreement that keeps you out of court.
You can plan the best approach to resolve your family law issues so that you can move on with your life when you have solid family law advice on what you need to do in your separation or divorce.
2. You and your spouse have already agreed on everything.
You think you and your spouse have already agreed on everything in principle.
This often is not the case. When your lawyer drafts the proposed agreement and sends it to your former spouse or their lawyer, they often want changes.
That’s to be expected.
You can usually still reach a fair and reasonable agreement with your former spouse when your spouse acts reasonably in general.
You just have to remember that negotiating a separation agreement and reach a settlement usually takes more time and money than you first expected.
3. You will get what you expect in your separation or divorce.
That’s rarely the case. You need to base your goals on what you can achieve in your separation or divorce based on an experienced family lawyer’s advice.
It does not matter what advice you get from your friends, co-workers and family members. They mean well. However, each family situation is different. There is no one-size fits all in Ontario family law.
You need to focus on what is reasonable to get in your case based on the application of Ontario family law to the specific facts of your situation. Then you and your lawyer can put together a reasonable settlement proposal.
When you continue to push for what you want regardless of Ontario family law principles, you will face some serious disappointment, frustration, mounting costs and expenses and a long-drawn-out separation and divorce battle.
Who wants that? No one!
