How to Negotiate Effectively with Your Former Spouse in Your Separation or Divorce in Ontario!

However, you need to know how to handle the negotiation process effectively behind the scenes to get the best results possible in your separation or divorce.

Here’s five ways to negotiate successfully with your former spouse in your separation or divorce:
1. Know Your Legal Rights in Your Family Law Case
First, you need to know your family law rights and how Ontario family law principles apply to your situation. Your family lawyer will definitely help you with that.
2. Be Mentally Prepared for Negotiating A Settlement
You must put your emotions aside as much as possible to negotiate an effective settlement agreement with your former spouse.
If you approach negotiating a settlement from an emotional point of view, you could very easily miss the opportunity to settle your case with a fair and reasonable settlement.
Your emotions can easily cloud what is a good settlement or a bad settlement.
Your family lawyer will certainly advise you about whether a settlement is fair and reasonable. However, you must still decide about the terms of a settlement. You can only do that when you take a calm, business-like approach to the negotiating process.
3. Don’t Let Your Spouse Intimidate You

Remember that what your spouse thinks about you is none of your business! You are your own confident person.

Your family lawyer must discuss in detail what terms that a solid settlement or separation agreement should include in your particular situation. It is not a case of one size fits all!
Your former spouse could send you a proposed settlement. Your family lawyer will certainly advise you whether you accept this proposed settlement or whether you should propose changes to the draft agreement.
Make sure your family lawyer always tells you “why” a proposed settlement is good or bad for you. This way you can always an informed decision about what you should do to protect your family law rights.
