However, if you expect the worst, that situation can easily cause your separation or divorce to drag out and cost you more money since you usually think your spouse is automatically offering you a bad deal or doing something else underhanded in family law case.
You need to take on a more realistic or objective point of view so that you succeed in your separation or divorce.
Here’s 9 key points you need to realize about your separation or divorce if you plan on winning your family law case:
1. Your separation or divorce will take longer than you realize!
Your separation or divorce will inevitably take longer than you think. It doesn’t happen in two or three months. That’s a very unrealistic expectation.
It normally takes 5 to 7 months to get a separation agreement negotiated and signed. When you are dealing with family court, the separation and divorce process takes even longer (usually 8 months to 16 months).
2. When your spouse runs a business or is self-employed, you will most likely get less child or spousal support than you think you should get!
You’ll face difficulty getting an accurate picture of your spouse’s real income when they a business owner or are self-employed.
Many business owners and self-employed persons do not report their true income on their income tax returns.
You can have a really tough time trying to determine your ex-spouse’s income when they are self-employed.
Therefore, your child support and spousal support payments will be lower since they are not based on your former spouse’s true income.
3. You need to have a clear picture of your family law rights based on the advice of an experienced Ontario family lawyer.
